Assumption of Risk & Agreement to Hold Harmless

I am at least eighteen (18) years of age, in good physical condition, and fully able to participate in Heeling Muskoka (HM) private consultations. I understand that HM private consultations are not without risk to myself, members of my family, guests who may attend, or my dog, because some of the dogs to which (I/we) may be exposed to may be difficult to control and may be the cause of injury, even when handled with the greatest amount of care or otherwise. I acknowledge the risks and hazards connected with the participation in private consultations, including but not limited to, dog bites, scratches, or other injuries incidental to contact with dogs.

In Consideration of my participation in the private consultations, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Heeling Muskoka Dog Training, their officers, servants, agents and employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by me, or to any property belonging to me, related to my participation in the private consultation, and while on or upon the premises where the training is being conducted.

I understand my responsibilities as a dog owner, as outlined in the Dog Owners Liability Act;

• The owner of a dog is liable for damages resulting from a bite or attack by the dog on another person or domestic animal.
  R.S.O. 1990, c. D.16, s. 2 (1).

I hereby acknowledge and agree that, even when handled with the greatest amount of care and every safety precaution has been exercised, or otherwise, dogs inherently can be unpredictable in nature. Therefore, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Heeling Muskoka Dog Training, their officers, servants, agents and employees, from any and all liability, legal responsibility, or any resulting lawsuit of any nature for any damages resulting from a bite or attack, by my dog, on another person or domestic animal.

I understand and agree to RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Heeling Muskoka Dog Training, their officers, servants, agents, and employees, of any responsibility, liability or accountability for failure to achieve desired results from my consultation due to my failure to follow the suggestions and recommendations as set out during my session. I expressly assume the risk, negligence, damage or any injury while following the advice and/or performing the techniques demonstrated to me during my session with HM, their officers, servants, agents and employees, as dogs inheritably can be unpredictable in nature and agree to hold harmless HM, their officers, servants, agents, and employees, on this ground.

Consultation Payment & Cancellation Policy

I hereby acknowledge and agree to making payments in full a minimum of twenty-four (24) hours before the scheduled private consultation.

Cancellations, rebookings and missed scheduled private consultations received with less than twenty-four (24) hours’ notice shall be subject to a cancellation fee in the amount of the cost of the appointment cancelled, rebooked, and/or, missed. Extenuating circumstances including but not limited to; road conditions, family medical emergencies, and the health of the dog will be provided consideration with regards to this policy.

Photo & Video Waiver

HM reserves the right to use any photograph/video taken at any event or private consultation facilitated by HM, without the expressed written permission of those included within the photograph/video. HM may use the photograph/video in publications or other media material produced, used or contracted by HM including, but not limited to: brochures, invitations, books, magazines, television, websites, social media, etc. By participating in a HM event or private session or by failing to notify HM, in writing, your desire to not have your photograph used by HM, you are agreeing to release, defend, hold harmless and indemnify HM from any and all claims involving the use of your picture or likeness.
